No Time To Call 911, Brother Arrests Carjacking Suspect Himself and Does It All ‘By the Book’

An Atlanta, Georgia resident had no time to call 911 when a man tried to rob him at gunpoint and steal his car. But the carjacker didn’t know that Hashim Fannin also had a gun, and was legally armed.

When the would-be carjacker got into the passenger seat, moments after Fannin pulled into a parking space, Fannin didn’t waste any time trying to get help, he took matters into his own hands.

“He told me, ‘You know what this,’” Fannin recalled. But Fannin didn’t hesitate. He pulled his own gun out and performed a citizen’s arrest “by the book.”

“I asked him to get out the car, probably not in those exact words,” Fannin continued.

“I told him no, there’s no leaving, leaving was before you hopped into my car… at this point there is not leaving.”

Fannin did everything right. Detaining the suspect and literally “arresting” him is a power given to any law abiding citizen who witnesses or is the victim of certain felonious criminal behaviors.

In the United States, most states have codified the common law rule that a warrantless arrest may be made by a private person – not even necessarily a “citizen” – for a felony, or in some cases a misdemeanor or “breach of peace”. This means that badges literally do not grant special or extra rights to police officers. Police officers have the power of arrest, because citizens the power of arrest. The rest is more social smoke and mirrors – as well as ignorance of the law – than it is anything else.

Police, naturally, arrived significantly later. In the video you can see Fannin waiving them down as they pull up.

When they start to park, Fannin places his firearm on the ground and steps away to make sure no trigger-happy officers shot him, the way they have in so many other cases of legally armed citizens defending themselves.

Even the officers were impressed with the arrest: “Good job, man!” they can be heard saying.

Another cop immediately shakes Fannin’s hand.

“Honestly, I look at it like this. That is one less guy I got to worry about bothering my mom when she’s out grocery shopping,” Fannin said.
